1. Definitions
In these Terms and Conditions:
- "Vuracia" means the premium ground transport service operating at vuracia.com.
- "Client" means any individual or organisation that books or uses a Vuracia transfer service.
- "Booking" means a confirmed transfer reservation, accepted by Vuracia in writing (email or SMS).
- "Service" means the ground transport provided from a specified pickup location to a specified destination.
- "Driver" means the licensed professional assigned to carry out a specific transfer.
- "Fixed Fare" means the fare quoted and confirmed at the time of booking, which does not change except in circumstances specified in these Terms.
2. Booking and Confirmation
- A booking is confirmed only when Vuracia sends written confirmation by email or SMS. An enquiry or quote does not constitute a confirmed booking.
- The Client is responsible for providing accurate and complete information at the time of booking, including pickup address, destination, flight number where applicable, travel date and time, and number of passengers.
- Vuracia reserves the right to decline a booking at its sole discretion, including but not limited to circumstances where vehicle availability does not exist or where the requested route falls outside our operational area.
- Bookings must be made in the Client's own name or by an authorised representative of a corporate account holder. Third-party bookings made without the traveller's knowledge are not permitted.
3. Fares and Payment
- All fares are quoted and confirmed in Canadian dollars (CAD) at the time of booking.
- The Fixed Fare covers the agreed route, standard luggage, and the wait time allowances specified in Section 5. It includes applicable tolls and parking.
- The Fixed Fare does not include: additional wait time beyond the included allowance; unplanned route deviations or additional stops requested during the trip; and any applicable gratuity.
- Payment is accepted by Interac e-transfer, Visa, Mastercard, and American Express. Cash payment to drivers is not accepted.
- Individual clients are invoiced by email after the trip is completed. Payment is due within 7 days of invoice date.
- Corporate accounts are invoiced monthly. Payment terms are Net 30 unless otherwise agreed in the account agreement.
- Vuracia reserves the right to charge interest on overdue invoices at 1.5% per month compounded monthly.
4. Cancellations
- Cancellations made more than 24 hours before the scheduled pickup time are free of charge.
- Cancellations made between 6 and 24 hours before the scheduled pickup time will incur a charge of 25% of the confirmed Fixed Fare.
- Cancellations made less than 6 hours before the scheduled pickup time, or where the Client fails to be present at the pickup location within the wait time allowance, will incur the full Fixed Fare.
- If a Client's flight is cancelled by the airline, the late cancellation fee will be waived provided Vuracia is notified as soon as the cancellation is known. Proof of cancellation may be requested.
- Vuracia reserves the right to cancel a booking in circumstances beyond our reasonable control, including severe weather, road closures, vehicle breakdown without available replacement, or driver incapacitation. In such cases, a full refund of any amounts paid will be issued.
5. Wait Time and Delays
- For departure transfers: the driver will wait up to 15 minutes from the agreed pickup time without additional charge. Beyond 15 minutes, additional wait time is charged at CAD 40 per hour, pro-rated.
- For arrival transfers at airports: free wait time of 60 minutes from the actual landing time is included. Vuracia tracks inbound flights and adjusts driver arrival accordingly. Beyond 60 minutes, additional wait is charged at CAD 40 per hour.
- For border crossing transfers: free wait time of 90 minutes at the crossing point is included in the fare. Extended border delays beyond 90 minutes are charged at CAD 40 per hour.
- If Vuracia is unable to provide a driver due to circumstances within our control, and this causes the Client to miss a flight or appointment, Vuracia's liability is limited to a full refund of the Fixed Fare paid. We do not accept liability for consequential losses.
6. Passenger Conduct
- Passengers are expected to treat drivers with courtesy and respect. Vuracia reserves the right to terminate a trip without refund if a passenger behaves in a manner that is abusive, threatening, or endangers the safety of the driver or other occupants.
- Eating and drinking of non-alcoholic beverages is permitted in vehicles at the driver's discretion. Consumption of alcohol in vehicles is not permitted.
- Smoking — including electronic cigarettes — is not permitted in any Vuracia vehicle.
- Passengers are responsible for any damage caused to the vehicle during a trip. The cost of cleaning or repair may be invoiced to the Client following the trip.
- Pets must be declared at the time of booking and transported in an appropriate carrier. Undeclared pets may result in refusal of service.
7. Luggage and Personal Property
- Standard luggage allowances apply as specified on our website. Oversized or unusually heavy items must be declared at booking.
- Vuracia accepts no liability for loss of or damage to luggage or personal property during a transfer, except where such loss or damage results from the gross negligence of our driver.
- Clients are advised to ensure personal valuables are carried with them and not placed in the vehicle's luggage area.
- Items left in a vehicle will be held for 14 days. Clients can arrange return of found property by contacting us directly; return courier costs are at the Client's expense.
8. Border Crossings
- Clients using border crossing transfer services are solely responsible for holding valid travel documents, including passport, visa, NEXUS card, or any other documentation required for crossing between Canada and the United States.
- Vuracia accepts no liability for denial of entry by border officials, delays due to secondary inspection, or any consequences arising from the Client's failure to hold appropriate documentation.
- Our drivers will assist clients in approaching the correct crossing lanes and may advise on general procedure, but are not immigration advisors and do not represent clients before border authorities.
9. Limitation of Liability
- Vuracia's total liability to a Client in connection with any single booking shall not exceed the amount of the Fixed Fare paid for that booking.
- We are not liable for indirect, consequential, or special damages, including missed flights, missed appointments, or business losses, except where such losses result from our gross negligence or wilful misconduct.
- We are not liable for delays or failures to perform caused by circumstances beyond our reasonable control, including traffic accidents blocking routes, severe weather, acts of government, or airline schedule changes.
10. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario.
11. Changes to These Terms
Vuracia may update these Terms from time to time. The version in effect at the time of your booking governs that booking. Updated Terms are posted on this page with a revised date. Continued use of our services after an update constitutes acceptance of the revised Terms.
